Members of LPC International’s professionally qualified senior staff have experience of
writing expert reports and acting as expert witnesses utilising our specialist knowledge and
experience in supply chain, logistics and distribution, materials handling and automation,
and operations. Our experts have been involved in logistics and supply chain consultancy for
over 25 years.

Expert Witness activities are headed by David Hayward-Browne. A mechanical engineer and
logistics expert with a distribution, warehousing and industrial background, David has been
involved in logistics and supply chain consultancy since 2000. Prior to that, he was involved
in designing, manufacturing, installing and project managing storage and automated
materials handling equipment before moving into distribution.

David has written expert reports and appeared as an expert witness are in warehouse
design and operations, materials handling and storage systems design and applications,
automation, overseas supply chains, 3rd party logistics, road transport, warehouse computer
systems and health and safety in warehouse and transport operations. David has given
evidence at UK and International Tribunals and in the Crown Court.

Recent Example Cases Include:

Warehouse Operations and “Interruptions” to Warehouse Operations

  • The dispute arose over the concept design for the production of modular homes. LPC was retained to determine whether it was technically, physically and economically viable to situate it within the chosen building.
  • Report on the impact on the operation and use of the racking due to cracking and subsidence of the warehouse concrete floor. The report covered the operational effects within the warehouse, the relocation / use of alternative premises to maintain operations while the problems with the concrete floor and foundations were remedied.
  • Report on the acquisition and setup of a new larger, and better-equipped facility to replace an old warehouse destroyed in an explosion. Assistance on logistical and operational issues was provided to the Property Expert and the Forensic Accountant.

Warehouse Automation

  • A review of the automated systems was undertaken for a grocer to determine whether the suppliers were liable for the inability of the operation to meet production targets, covering the design, equipment and control systems (WMS & WCS).
  • A report was produced for an Integrator on the failure of an automated pallet conveyor system covering the design, installation, remediation attempted and fitness for purpose.
  • Retained to produce a report covering the potential causes of the collapse of an automated high bay racking system and identifying the underlying operational issues. A presentation was made to the International Arbitration Tribunal followed by cross examination.
  • Report on the performance of an automated warehouse and warehouse management system (WMS). David’s involvement included agreeing and witnessing operational tests, producing reports and joint memoranda and giving evidence to the Arbitration Tribunal.

Warehousing and Distribution Facilities and Property Issues

  • Retained to produce a report on factory and warehouse design and operation, and compare potential layouts and operational methods for a company producing aluminium sections and fabrications for windows and construction, in a dispute over the impact of a gas pipeline on their facility expansion and operation. Evidence was given at the tribunal.
  • Assessment of how long it would take for a property to be cleared of a number of large boilers, shipping containers and other material and whether it could be done within the time stated in the contract. He produced a report covering the process, equipment and resources required, produced a programme and identified the order of cost involved.
  • Retained by a dairy manufacturer to consider material flows on site and comment on and advise on the potential options for expansion to support their plans for expansion at a Planning Enquiry.

Transport and Distribution

  • Instructed to provide an expert report for an HSE Tribunal on the design, layout and operation of the yard of a transport contractor looking at movement and circulation of vehicles and pedestrians in a safe manner. Evidence was given at the Hearing, the subsequent appeal and in the Crown Court.
  • Report on the documentation, processes, training and risk assessments of the delivery operations of a Wholesaler following an incident.
  • Report for a 3PL in Ireland in a contract dispute concerning the management and supply of distribution services.
  • Retained to produce a report on the movement and handling of shredded sugar beet between sugar mill, storage facility and energy production site.

Logistics IT Systems

  • Retained to produce a report for a discount retailer addressing the allegation that the stock allocation system was overstocking the stores leading to breaches of health and safety rules. David was able to ascertain and explain that the company’s IT systems and processes were robust and that the issues were due to errors in store. He gave evidence in the Crown Court.
